Working with a Divorce Attorney
Although you may wish to settle matters with your spouse quickly and amicably, sometimes that’s not possible. Taking legal action in order to protect the well-being of your children might be the best course of action. Having a knowledgeable and experienced attorney is very critical when it comes to protecting your rights and maintaining the standard of living you have grown accustomed to.
What is dissolution of marriage?
Dissolution of marriage occurs when both parties mutually agree to terminate their marriage. Neither party has to prove grounds to end a marriage by dissolution. Dissolution occurs when a husband and wife have reached a separation agreement regarding all property, spousal support and any child issues.
The parties jointly file a Petition for Dissolution, and must wait at least 30 days before the court will hear their case. The case must be heard within 90 days of filing. During the hearing, the court will review the separation agreement, inquire about the assets and liabilities and any parenting issues. The court will determine whether both parties understand and are satisfied with the settlement. When the court is satisfied that the agreement is fair, the dissolution will be granted and the separation agreement will take effect.

Property Settlement During Divorce
There are certain considerations that can influence how your marital assets and property will be divided. Most people understand that the property you bring into a marriage is your own. However, the ‘bringing together’ of assets during the course of your marriage can make property division complex. Because every situation is different, we take the time to listen to clients and understand what they’d like to achieve during property settlement. Our experienced attorneys will help you in determining a fair and reasonable property division plan.
Family Law: Alimony and Spousal Support
Family law attorneys who will help you obtain the spousal support you need
There are numerous factors at play when judges determine the amount of spousal support to be paid or received. Such factors include:
- Relative incomes of the parties
- The ages and health of the parties
- The duration of the marriage
- Whether one of the persons will not be able to earn a salary because of child care responsibilities
- The contributions of each party to the earning ability of the other through education and training
- Assets and liabilities of each party
Judges take these factors into consideration when determining whether to award spousal support. They also decide whether temporary spousal support should be paid to a spouse. This temporary support can be used to obtain education or training necessary to be able to get a job. Our family law attorneys will help you plan the most appropriate steps to take to ensure you receive the best resolution for your situation.
Family mediation is a type of alternative dispute resolution. It gives the parties involved in a divorce the opportunity to come to an agreement on divorce terms. This is often more appealing than having terms imposed on them by a judge. This process is usually more amicable than going to court and will often result in both parties walking away more satisfied. Our expert divorce lawyers will make sure that you walk away with a solution that is acceptable and fair to all parties involved.
Family Law: Paternity Representation
Effective paternity representation is necessary to protect every child’s best interests as well as your own legal rights. At Ziccarelli & Martello, our experienced paternity lawyer will help you protect your rights for child support or child custody or visitation. We can also help you to avoid child support obligations in case DNA test results prove that you are not the father of a child.
If you are the victim of domestic violence, our lawyers can help you secure a protective order. A temporary order of protection will help to keep you and your children safe from further harm or danger. A parent charged with domestic violence could lose custody and visitation rights, so if you’ve been charged with domestic violence, it’s important to take action quickly. Our lawyers understand the issues involved in domestic violence cases and are ready to work with you through this difficult process.
Family Law: Adoption
Adding a new member to your family should be a joyous occasion.
